Extract from Cottingley Town Hall Trust Deed
TRUST
....that the said parties hereto of the fourth part and the survivors of them and the heirs of
such survivors and their and his assigns shall let such portions of the sittings in the said
Edifice as they or a majority of them in meeting assembled shall direct and shall apply the
money to arise therefrom towards payment of all expenses that may be incurred in continuing t
he said edifice to the extent to which it shall have been so appropriated for a Sabbath School
and Religious Meetings and preachings either in repairs or otherwise and towards paying the
interest of any money that may be borrowed of the said premises pursuant to the powers herein
contained
Provided always and it is hereby
declared that if any trustee of the said trust premises shall cease to be of the Protestant
Religion or to reside within the West Riding of the County of York he shall thereupon cease
also to be such trustee as aforesaid and his estate and interest in the said trust premises
shall also cease in the same manner as if he were dead.
Provided also and it is hereby declared that when and so after as the trustee herein named or
to be appointed as herein after mentioned shall by death or ceasing to be of the Protestant
Religion or residence out of the said West Riding or by refusing or becoming incapable to act
as such trustees be reduced to seven in number so many persons as shall be appointed to be
new trustees as will make up the original number of 13 Trustees and such appointment shall
take place as follows
The owner or owners for the time being in possession or in receipt of the rents of the Saint
Ives estate in the said Parish of Bingley shall be at liberty from time to time to appoint one
trustee in the place now filled by the said WF (William Ferrand) the elder and if such estate
shall be vested in a sole male owner he shall be at liberty to appoint himself or any other
eligible person
The owner or owners for the time being in possession of the rents of the Hollings estate as
Cottingley aforesaid shall be at liberty from time to time to appoint one Trustee in the place
now filled by the said John Hollings and if such estate shall be vested in a sole male owner he
shall be at liberty to appoint himself or any eligible person.
The Committee of the Sunday School shall furnish to the surviving or continuing Trustees a list
in writing containing the names of double the number of persons required to supply the vacancies
to be occasioned by the ceasing to be of the said Thomas Raines, James Fyfe, George Bishop,
William Ferrand and Adam Pollard or their successors in office.
The Committee of the Day School shall furnish to the said surviving or continuing Trustees a
list containing the names of double the number of persons required to supply the vacancies to be
occasioned by the ceasing to be Trustees of the said Isaac Skirrow Smith, James Moore and
Mark Dickinson or their successors in office.
And the Committee of the Mechanics Institution shall furnish to the said surviving or
continuing Trustees a list containing the names of double the number of persons required
to supply the vacancies to be occasioned by the ceasing to be Trustees of the said Kaberry
Baines, Joshua Laycock and Joseph Wilson Thornton or their successors in office
And all the persons to be appointed to be Trustees respectively shall consist of Members of
the Church of England and of the churches or congregations of independent Baptists or Wesleyans
and so that the Trust when full may always include some members of all the said religious bodies and
if any dispute at anytime hereafter shall arise as to the relative number to be chosen out of
any of the said bodies
In particular the same shall be determined by the Committee of the Sunday School whose peculiar
duty it shall at all times be to see that each of the before named religious bodies be
represented whenever a new appointment of Trustees is necessary or is considered expedient.
And the surviving or continuing Trustees shall at a meeting duly convened and holden for the
purpose from the said lists to be furnished as aforesaid choose and appoint the requisite and
proportional number of persons to be Trustees of the Trust property and when such choice and
appointment shall have taken place the same shall be made to appear by some Deed under the
hand and seal of the Chairman for the time being at which such choice and appointment shall
be made executed in the presence of such meeting and attended by two or more credible witnesses
which Deed may be in the form of or to the like effect of the schedule annexed to the Act of
Parliament passed in the fourteenth year of the reign of Her present Majesty Queen Victoria
"to render more simple and effectual the titles by which congregations or societies for
purposes of religious worship or education in England and Ireland hold property for such
purposes" or as near thereto as circumstances will allow or in any other form which may be
applicable to or convenient for the purpose.
And it is hereby declared that each Committee shall be convened for the purpose of
selecting persons to be submitted as proper to be new Trustees of the said trust premises by a
notice from the respective secretary of such committee printed or written or partly printed and
partly written which notice such secretary is hereby authorised to give upon request by any
member of such committee.
And the majority of the committee present pursuant to such notice shall nominate the persons
to be submitted by such committee to the surviving or continuing Trustees for the choice and
appointment among them of persons to be appointed new Trustees of the said Trust premises.
And also that the committee of each institution shall manage the special business of that
institution but that the management of the buildings and premises as to the particular purposes
of their appropriation. The parties permitted to use them shall be vested in an Executive
Committee to be selected from the committees of the respective institutions in the following
proportions namely:-
3 from the Sunday School Committee
2 from the Day School Committee
and 2 from the Mechanics Institution Committee
and one of the members of each committee shall retire annually, by rotation
And those who retire at the end of the first and other years until the whole of the committee
but one shall have retired in their turns shall be determined by lot and afterwards the
member who has since his election or re-election (as the case may be) been longest in office
and all retiring members shall be capable of being re-elected.
And also that the Executive Committee shall pay, control, and proportion the several
expenses of repair of lights, fire interests, attendance and other incidental matters
and things relative to the trust premises and affairs in such manner as they shall think
most equitable and that they shall be.
And they are hereby empowered to charge such sum as they shall think fit for special purposes
not in connection with any of the said three institutions the clear money realised therefrom
being applied in aid of the funds of the said Sunday School.
And it is hereby declared that all powers of the Trustees for the time being under these
presents (except as otherwise herein provided) may be exercised by any five or more of the
Trustees present at any meeting of Trustees but no business shall be transacted at any
meeting of Trustees unless 5 Trustees be present.
And also that all notices of any meeting of the said Trustees shall be in writing or print,
or partly in writing and partly in print and shall be by the Chairman or Secretary of the
said Trustees delivered or sent by the post or otherwise to the usual place of abode or place
of business if any of each of any of the said Trustees 7 days at least previous to such
meeting and such notices shall be issued upon ........................
